Kabayan Henry,
Sa portal announcement ito ang nakalagay:3. (Re-employed) workers in Korea who are in their second sojourn period – the remaining portion of their three year sojourn period.
Ibig po sabihin kung natapos nyo na ang 3 yrs. at na RE-HIRED kayo, tatapusin nyo ang natitirang taon, total of 6 yrs. pagkatapos nyan, wala na po extension.
Kung hindi na kayo i-renew, dapat i RELEASE kayo ng employer nyo para makahanap kau ng another employer dahil RE-HIRED na kau.

kabayan,
kung ano ang current minimum wage yun ang dapat sundin ng employer... hindi po pwede na mas lower ang sahod nyo sa minimum wage... kaya nga from the word "minimum", kasi yan ang pina ka bottomline... pwede mas malaki ang sahod kaysa minimum wage but if lower, it's already a violation of the law...
effective Jan. 1, 2010, minimum wage per hour is 4,110won na... while for overtime work, 6,165won per hour... and for night differential (working from 10PM ~ 6AM), 2,055won per hour... pls refer below for more details...
-> basic monthly wage for 40-hrs workweek system: 858,990won -> basic monthly wage for 44-hrs workweek system: 928,860won
if you find out na below minimum wage ang current sahod nyo, magreklamo kayo sa amo nyo... |

kabayan,
ayon po sa EPS policy, 3-times release lang po talaga ang allowed sa loob ng 3-yrs sojourn mo. pero if meron kang isang release na ang reason ay closure of company due bankruptcy, hindi po yun dapat i-include sa counting...
after your 3-yrs sojourn is expired and you will be reemployed by your current employer for another 1yr and 10mos, meron ka na namang panibagong 2-times release sa loob ng 1yr at 10mos na sojourn mo...

ilang regular workers po ba kayo dyan sa company? if less than 5 lang kasama ang mgha korean workers, yung overtime work nyo discretion po ng amo nyo kung magkano lang bayad... or kung ano lang ang nakalagay sa kontrata nyo kasi limited lang po ang benefits ng workers sa family business according to Labor Law...
pero dapat sinusunod pa rin ang current basic hourly minimum wage na 4,110won per hour or katumbas sa 928,860won sa isang buwan working 8hrs Mon~ Friday plus 4hrs Sat... if meron kayong overtime, dapat mataas pa dyan ang sahod nyo...
pero kung more than five naman kayo lahat dyan, the company should pay you additional 50% during overtime work and nightshift work which is 50% x 4,110 = 2,055won (additional wage per hour)
so, for example if you work 30hrs overtime in one month, the computation is 30hrs x (4,110 + 2,055) = 184,950won (total overtime wage) in addition sa basic salary mo na 928,860won
if 800,000won lang basic nyo, violation po yan ng company... matagal na ba kayo dyan? magrereklamo kayo sa amo nyo... or punta kayo ng labor office...

| sir Dave ano nman po yung siasabi nilang for the 1st 3months may bawas na 10% ang sahod ng baguhan sa comp kanino ba pwedenng mai apply to kindly give some clarifications at ex. pag noon ay d binawas yun tapos nagkaroon ng problema at magparelis yung tao pwede po bang ikaltas ng kompanya yun? tsaka isa pa po halimbawa d sumunod comp sa labor ex. sahod oras,at nagfile ng petition ang employee pwede rin bang sabihin ng comp na libre nman bahay.ilaw etc..tapos compute lahat pwede ba ikaltas ulit sa worker ang binigay na libre tsaka bonus pla..pakiclaro nman po

please refer below for my answer based from Labor Standard Act and NLCC's explanation...
1) 3-months Probationary Period with 10% salary deduction is actually not specified in the Labor Standard Act particularly to E-9 Visa holders... but employers may apply but there must be an mutual agreement between the worker and the employer through Employment Contract and should be approved by the competent Local Labor Office... if the probationary period condition is aplied without the agreement by the concerned worker (not stated in the contract) and without the approval from the Labor Office, violation na po yan... IN THAT WAY HINDI PO PWEDE MAGDEDUCT ANG EMPLOYER NG ANY AMOUNT SA SALARY...
2) ung libreng pabahay, pagkain, at bonus, descretion po yan ng company to give such benefits to the employer but IT DOES NOT MEAN NA DAHIL LIBRE KAYO PWEDE NA SILANG HINDI MAGBIGAY NG TAMANG SAHOD ACCORDING TO THE MINIMUM WAGE... hindi po pwede ideduct yun sa salary ng isang worker sakaling magpaparelease kayo...

| magandang gabi po ty for the promt reply sir Dave..pwede ko na pong pag aralan ang mga to..yung yaksuk wolgeb po bale sa atin an agreement bet the employer and employee about salary karamihan sa korean ganun yata kasi ng pag sunod sila sa labor mahihirapan da w sila sa pagcompute or tmad sila ika nga hehe..tapos gagawa sila ng written letter(agreement) then sign tapos nagkaroon ng conflict pwede rin pa bang i-insist ng employee na or magreclamo sa labor?then sa sulay pinoy t shirt nman po its was a very good idea sana patuloy pa rin ang paglago ng sulay pinoy..again ty ty ... |

about "yaksuk wolgeb", i think wala pong problema yan as long as hindi po na-violate ang minimum wage... but if lugi po ang worker, hindi na po tama yun... the minimum wage law must be followed... pwede talaga kayo magreklamo sa labor office... yung agreement na yan ay baseless pagdating sa minimum wage law... thanks... |
